Woensdag 28 maart vond de zevende procesdag van Peike’s hoger beroep plaats. Zoals aangekondigd in de vorige zitting maakte de rechter haar besluit bekend omtrent de aanvraag van nieuwe getuigen door de verdediging. De aanvraag voor het horen van een agent van de SoKo Schwarzer Block (een speciaal opgerichte groep agenten die onderzoek doet naar al het bewijsmateriaal over het “zwarte blok” tijdens de G20-top) werd verleend. Zij is echter op dit moment op vakantie, dus zal pas in de zitting van 19 april gehoord worden. De andere aangevraagde getuige wil de rechter niet horen. Deze agent was op de dag van Peike’s arrestatie deel van hetzelfde team waar ook Kosnik en Marx in zaten. Volgens de rechter kan deze agent niet meer informatie over het voorval hebben dan de getuigen Kosnik en Marx al gegeven hebben. 

Daarnaast eiste de verdediging in deze zitting weer Peike’s onmiddellijke vrijlating in afwachting van het verloop van zijn proces, met als onderbouwing onder andere de niet op elkaar aansluitende getuigenissen van Kosnik en Marx, en het meerdere keren veranderende
signalement van de flessenwerper. 
Deze zaken overtuigden de rechter echter niet. De verschillende verhalen praatte ze recht met de verschillende blikvelden van beide getuigen; Marx stond immers voorin de rij, terwijl Kosnik achteraan stond. Daarnaast stelde ze dat het ook logisch is dat de ze niet exact hetzelfde gezien en verklaard hebben omdat alles in enkele seconden gebeurde. Ook het wisselende signalement achtte ze niet relevant. Volgens haar kan samengebonden krullend haar in het donker namelijk makkelijk voor dreadlocks aangezien worden.
De rechter gelooft de getuigen nog steeds, en blijft bij de originele verdenkingen.

Tenslotte verklaarde de rechter dat haar agenda, na het horen van de derde getuige, leeg is. Desondanks worden de komende twee geplande procesdagen niet gecanceld. Haar verwachting is dat de verdediging deze zal invullen.

Ondertussen houdt Peike zich sterk. Voor iedereen die de mogelijkheid heeft om naar een van de nog geplande zittingen te komen: de solidariteit blijft nodig en wordt ontzettend gewaardeerd.

The 7th day of trial of Peike’s appeal trial took place on Wednesday March 28. As announced during the last session, on this day the judge would make her decision on the defense’s request for new witnesses public. The request of hearing a next witness: a cop belonging to SoKo Schwarzer Block (a cop unit founded specifically to investigate proof related to the “black bloc” during the G20) was accepted. At the moment however she is away on holiday, so she will only be heard in the session of April 19. The other requested witness will be brought before court. This cop pertained to the same team as Kosnik and Marx on the day of Peike’s arrest. According to the judge, this cop can therefore not have more information about the incident than the witnesses Kosnik and Marx have already given.

Furthermore, the defense during this session once again demanded Peike’s immediate release, i.e. awaiting the course of his court case in freedom, using as arguments the contradictory statements of Kosnik and Marx, and the repeatedly changing description of the person who threw the bottles.
These arguments however did not convince the judge. The different statements of Kosnik and Marx were justified using the witnesses’ different perspectives; at the time of the incident, Marx was standing first in line, while Kosnik stood in the back. The judge also stated it is logical they did not see or declared exactly the same thing, as everything happened in a split second. The description of the accused having changed multiple times she considered irrelevant. In the judge’s opinion, in the dark a bundle of curly hair could easily be mistaken for dreadlocks. The judge continues to believe the witnesses, and still considers the original accusations valid.

Finally the judge declared that her agenda will be empty after having heard the third witness; despite this however, the next two court days will not be cancelled. Her expectation is that the defense will fill up these days.

In the meantime Peike continues to be strong. To everyone who is able to come to one or more of the planned court days: solidarity is still necessary and much appreciated.
