Afgelopen vrijdag was de derde dag van Peike’s hoger beroep. Ter voorbereiding van de zitting hadden Peike’s advocaten de rechter een brief gestuurd, die zij (de rechter) nog niet gelezen had omdat ze op vakantie was geweest. Ze sloot de zitting dan ook vrijwel direct nadat ze dit gezegd had. Volgende week zal het proces weer verder gaan in drie geplande zittingen. Hopelijk zullen deze uitgebreider zijn…

Hoewel de zitting letterlijk maar twee minuten duurde, was er een hoop support aanwezig, wat Peike heel erg fijn vond. Alle geplande zittingsdagen staan op de events pagina, en alle mogelijke support daarvoor wordt heel erg gewaardeerd.

Last friday the third day of the appeal took place. In preparation of the hearing Peike’s lawyers had sent a letter to the judge about the case, but since she (the judge) just went on vacation, she closed the hearing right after telling that she did not have time to read the letter yet. Next week three court days are planned, which will hopefully be more extensive. 

Even tough the hearing literally only took two minutes, there was a lot of support present, which Peike liked a lot. All planned court dates are listed at the event page, and all support is very welcome.

Vrijdag 16 februari was de tweede dag van het hoger beroep van Peike. Omdat het Kurzbericht dat tijdens de eerste zittingsdag nog miste uit het dossier er inmiddels aan was toegevoegd, wilde de rechter door met het verhoor van getuige Kosnik. Naast het Kurzbericht was er echter ook andere nieuwe documentatie opgedoken waaruit blijkt dat de verklaringen van Kosnik niet uitsluitend gebaseerd zijn op zijn eigen waarnemingen en herinneringen. In een mailwisseling tussen Kosnik en een collega van de Hamburgse politie waarin Kosnik gevraagd wordt het Kurzbericht op te stellen, wordt namelijk ook voor hem uitgespeld wat hij waar op welk moment heeft gedaan, onder het mom van “voor als je het je zelf niet meer goed kan herinneren.” Kosnik’s verklaring is vrijwel letterlijk aangeleverd door een smeris uit Hamburg.

De verdediging betoogde dan ook dat Kosnik’s getuigenissen ontoelaatbaar verklaard moesten worden. Bovendien eisten zij – gezien het feit dat de gehele veroordeling van 28 augustus (toen Peike veroordeeld is tot 2 jaar en 7 maanden celstraf) gebaseerd was op deze nu dus gecompromitteerde getuigenissen van de smeris – Peike’s onmiddellijke invrijheidstelling. De aanklager reageerde op dit betoog dat de informatie in de email niet bedoeld was de getuigenis van Kosnik te sturen, maar dat de uitgebreide situatieschets nodig was om Kosnik duidelijk te maken over welk voorval tijdens de G20 hij een verslag moest opstellen.  

Na een aantal onderbrekingen besloot de rechter, ondanks het ontbreken van enige getuigenis vóór het email contact met de Hamburgse smeris, de eisen van de verdediging niet in te willigen. Het email contact was naar haar mening niet zwaarwegend genoeg om de getuigen niet te horen, laat staan om Peike vrij te laten. De verdediging diende eerst met meer bewijs te komen dat de politie liegt. Totdat dat bewijs is aangeleverd, blijft Peike in haar ogen vooralsnog een veroordeelde, die een gevaar voor de samenleving vormt.

Omdat de email correspondentie nog steeds niet volledig in het dossier zit en er eindeloos over data voor de komende zittingsdagen gesproken moest worden, zijn de getuigenissen van Kosnik en Marx deze zitting niet meer hervat. De eerstvolgende zittingsdag is verplaatst naar 9 maart. Deze zitting zal waarschijnlijk maar twintig minuten duren en enkel bestaan uit een check of alles nu aanwezig in het dossier. Het horen van de getuigenissen zal naar het er nu uitziet vervolgens op 20 maart (tijdens de tweede dag van in totaal 10 nieuw geplande dagen) worden hervat.

Last Friday, Februari 16th, the second court day of Peike’s higher appeal took place. The Kurzbericht that was missing from the file during the first court day was now added, so the judge had intended to continue hearing the witness Kosnik. However, in addition to the Kurzbericht other documentation – from which it became clear that Kosnik’s statements did not solely rely on his own observations and recollections – had also come to the surface. In an e-mail exchange between Kosnik and one of his collegues from the Hamburg police departments, Kosnik is asked to write the Kurzbericht. Under the guise of “in case you can’t remember this properly yourself”, it is spelled out to him in that same e-mail what he supposedly did where and when. In other words, Kosnik’s statement has been drawn up (almost to the letter) by a cop from Hamburg.

In response to this, the defence petitioned for Kosnik’s statements to be declared inadmissible. Furthermore, they demanded Peike’s immediate release, seeing as his previous conviction hinged entirely on the now compromised cop statements. The prosecutor ‘countered’ that the information in the e-mail had not been added with the intention of influencing Kosnik’s statements, but that the extensive description of events was merely necessary to communicate to Kosnik of which G20 incident he was supposed to draw up a rapport.    

After a sequence of breaks, and despite the absence of any type of witness statement dating prior to the e-mail exchange with the Hamburg police, the judge decided not to comply with the demands of the defence. She ruled that the e-mail exchange did not carry enough weight to dismiss the witnesses, let alone to release Peike. The defence would have to come up with more evidence that the police is indeed lying. As of yet, Peike will remain a convict and a threat to society to her until that evidence is presented.

Because the e-mail correspondence was still partly missing from the file and the court had to consult endlessly about the dates for the upcoming court hearings, Kosnik’s and Marx’s testimonies have not been resumed anymore during this past hearing. The next court day has been moved to March 9. In all likelihood this session will consist only of a check up to see if all relevant documentation is now present in the file, and will therefore only last about 20 minutes. The witness interrogations will probably be resumed on the 20th of March, during the second day of 10 newly planned court days in total.

Since the public prosecutor is not able to attend the next planned trial day (5th of March), this day is cancelled. During the last hearing the judge planned a lot of new court days, of which a lot will be very short (9:00-11:00, 9:00-12:00 etc.). The new dates are the 9th, 20th, 21th, 23th and 28th of March, and the 3th, 5th, 19th, 25th and 26th of April. Please check events for time and place.

Afgelopen vrijdag, 9 februari 2018, was de eerste procesdag van het hoger beroep van Peike. Om Peike te supporten waren er ongeveer 30 mensen uit Amsterdam naar de rechtbank in Hamburg gekomen om daar samen met een grote groep Duitse kameraden de rechtszaak bij te wonen. Ook was er weer koffie, muziek en ontbijt voor de rechtbank vanuit de Duitse anti-G20 supportgroep. Binnen in de rechtbank werden de supporters “verwelkomd” door relpolitie.

Tijdens de zaak werden twee smerissen uit Berlijn (Kosnik en Marx) opgeroepen als getuigen. De ochtend verliep echter heel sloom en bestond voornamelijk uit onderbrekingen omdat zowel Kosnik als Marx geen verklaring hadden van hun baas omtrent wat ze wel en niet mochten zeggen in de rechtbank. Na de lunchpauze begon de rechter met het ondervragen van Kosnik, die in de eerste rechtszaak claimde Peike twee flessen te hebben zien gooien. Het document (Kurzbericht) dat door Marx (de smeris die claimt door de flessen geraakt te zijn, en de arrestatie waarschijnlijk afgemaakt heeft) is opgesteld na de arrestatie, miste echter in het dossier, terwijl dit document de basis vormde voor de getuigenis van Kosnik.

Hierna was de verdediging aan bod om Kosnik te ondervragen. Hij antwoordde op vrijwel elke vraag over 6 juli (de dag van Peike’s arrestatie) zich het niet meer te kunnen herinneren. Op de vragen met wie hij werkte, waar de arrestatie precies plaats had gevonden, wie Peike vervolgens afgevoerd had, of er een bevel was geweest om te arresteren, hoe de arrestatie was verlopen, wat hij na de arrestatie de rest van de dag gedaan had en tot hoe laat zijn dienst geduurd had, bleef een antwoord uit. Daarnaast was Kosnik’s signalement van de flessenwerper ook veranderd. In tegenstelling tot zijn originele verklaring waarin hij stelde dat de werper dreadlocks had, claimde hij nu een man met langer haar en baard gezien te hebben.

Vanwege de vele onderbrekingen om vormfouten te corrigeren is Marx de 9e niet aan bod gekomen. Ook Kosnik’s getuigenis is niet afgemaakt. Hiermee zal 16 februari begonnen worden, en dan zal ook Marx ondervraagd worden. Na de 16e staan er nog vier procesdagen gepland op 5 maart, 20 maart, 5 april en 26 april. Peike was zichtbaar blij met alle mensen die gekomen waren om hem te supporten, dus mocht je de mogelijkheid hebben naar de komende zittingen te komen, dan wordt dit erg gewaardeerd.

Last Friday, February 9 2018, the first court day of the higher appeal in Peike’s case took place. Around 30 people travelled from Amsterdam to the court in Hamburg to support Peike, and a big group of German comrades was also present at the trial. In front of the courthouse there was coffee, music, and breakfast arranged by the German anti-G20 support group. Inside, the public was “welcomed” by riot police.

During the trial two cops from Berlin (Kosnik and Marx) were heard as witnesses. Generally the day progressed slowly and consisted mostly of interruptions, since neither Kosnik or Marx had a statement from their boss which stated what they could or could not say. After the lunch break the judge began questioning Kosnik, who during the first case stated he had seen Peike throw two bottles. The document (Kurzbericht) which Marx (the cop who claims having been hit by the bottles, and who probably finalised the arrest) made up after the arrest however was missing in the file, while Kosnik’s witness statement was based on this document.

After this, the defense interrogated Kosnik, who answered practically every question concerning July 6 (the day of Peike’s arrest) by stating that he did not remember. The questions concerning who he had worked with, where the arrest had taken place, who had brought Peike to the police station, whether there had been given an order to arrest, how the arrest took place, what he had done after the arrest during the rest of the day and when his shift ended, all remained unanswered. Besides, Kosnik’s statement about the appearance of the bottle-thrower had also changed: previously, in his original statement, he said that the person throwing had dreadlocks, whereas now he claimed to have seen a man with longer hair and a beard.

Due to the many interruptions in order to correct formal errors Marx was not heard as a witness on the 9th, and neither was Kosnik’s interrogation done by the end of the trial. The next court session, on February 16, will begin with this, and Marx will also be heard then. After the 16th four subsequent court dates have been planned, on March 5, March 20, April 5 and April 26. Peike was visibly happy with all the people who came to support him, so if you are able to come to the next sessions, this is much appreciated!
