Vrijdag 11 mei vond de veertiende dag van Peike’s hoger beroep plaats. Deze zitting werd met vier aanvragen vrijwel volledig ingevuld door de verdediging. Dit begon met de aanvraag voor het uitnodigen van drie nieuwe getuigen aangaande het in de achtste zittingsdag aangevraagde videomateriaal dat in de tiende zittingsdag is afgekeurd als bewijsmateriaal. 

Ten eerste vroeg de verdediging om agent Witte, werkzaam voor de SoKo Schwarzer Block (1), te horen. Hij heeft het videomateriaal van de SoKo doorzocht maar kreeg daarvoor enkel twee foto’s van Peike, die op een later moment genomen zijn. Zijn uiterlijk en kleding tijdens het voorval waren voor Witte dus onbekend. Daarnaast is hem alleen gevraagd in de video’s naar Peike te zoeken en helemaal niet naar het voorval zelf. Ook was tijdens deze zoektocht nog niet al het materiaal verzameld bij de SoKo.

Daarna werd om agent Dosen gevraagd. Ook hij heeft naar video’s gezocht, maar op andere locaties dan die van de arrestatie, waarbij ook hij enkel naar Peike heeft gezocht, en niet naar wat er verder daadwerkelijk gebeurd is.
Tenslotte werd gevraagd agent Klaffert als getuige bij de zaak te betrekken. Hij maakte de compilatie om de situatie rond de locatie te schetsen (het enige videomateriaal in de akte) maar kreeg daarbij niet eens de informatie dat er daar überhaupt iets zou zijn voorgevallen.

Daarnaast werd in deze aanvraag ook gereageerd op het besluit het videomateriaal af te keuren. Er is toen namelijk door de rechter gezegd dat er wel naar de flessenworpen is gezocht, wat simpelweg niet waar is. Dit argument voor het afwijzen van het nieuwe bewijs is dus zeker niet afdoende. 

Vervolgens vroeg de verdediging in de tweede aanvraag om het uitnodigen van agent Massner als nieuwe getuige. Hij heeft agent Witte de opdracht gegeven in het videomateriaal te zoeken, en daarbij dus ook de totaal onvolledige informatie over naar wat er gezocht moest worden gegeven. Zonder zelf naar de video’s te hebben gekeken, heeft hij vervolgens verklaard dat de daad van Peike niet op het materiaal te zien was, wat voor de rechter genoeg was het materiaal te weigeren als nieuw bewijs.

Hierna pleitte de verdediging in de derde aanvraag voor het als getuige uitnodigen van agent Krischlak. Hij was tijdens de arrestatie werkzaam in dezelfde groep als getuigen Kosnik en Marx en kan hopelijk meer vertellen over het voorval en de hoe het handelen van zijn groep toen geweest is.

Tenslotte werd in de vierde aanvraag gevraagd om het aan de akte toevoegen van de mail van de Hamburgse politie aan Marx en Kosnik. Dit document mist ondanks haar relevantie nog steeds in het dossier.
Ook kondigde de verdediging aan dat er binnenkort nog een aanvraag voor een nieuwe getuige komt, omdat de tekst voor de aanvraag tijdens deze zitting nog niet af was.

Terwijl de aanklager nog niet op de aanvragen wilde reageren, besloot de rechter al dat agent Krischlak zo snel mogelijk gehoord gaat worden. Volgende week zal de rechter op de andere drie aanvragen reageren en zal hopelijk ook begonnen kunnen worden met de getuigenis van Krischlak.

Aankomende week zal het proces vervolgd worden op maandag en donderdag. De nieuw geplande zittingen daarna zijn nog niet bekend, maar zullen zo snel mogelijk hier gepubliceerd worden. Toon je solidariteit aan Peike en kom ook naar de Hamburgse rechtbank!

Friday, May 11, was the fourteenth day of Peike’s appeal. With four requests, this day was almost entirely filled by the defense. This started with a request for inviting three new witnesses in relation to the videomaterial that was requested on the eighth day of court and denied as evidence on the tenth day of court.

First of all the defense asked to hear officer Witte, who works for the SoKo Schwarzer Block (1). He has searched the video material but to do so only received two pictures of Peike, which were taken at a later time. Because of this Witte was unfamiliar with his looks and clothing during the incident. Secondarily he was only asked to look for Peike in the video evidence, but not for the incident itself. An other factor is that during this search not all video material had been collected at the SoKo yet.

After this the defense asked for officer Dosen. He too has searched for video’s, but in different locations than that of the arrest. He too has only searched for Peike, and not for what has actually happened.

Finally the defense asked to add officer Dosen as a witness to the case. He made a compilation in order to show the situation around the location (the only videomaterial in the files) but was not even told that there had been an incident there.

In this request there was also a response to the video material not being admitted as evidence. This is because the judge had said that the material had been searched for bottle throwing, something that is simply not true. This argument for denying the new evidence is therefore not sufficient.

In the second request the defense asked to invite officer Massner as a new witness. He is the one that ordered officer Witte to search the video material and in this he has given incomplete information as to what the material had to be searched for. Without having seen the video evidence himself he has gone on to declare that the incident that Peike stands accused of was not visible in the material. This was enough for the judge to deny the material as new evidence.

After this the defense asked in a third request to call on officer Krishlak as a witness. During the arrest he was part of the same group as witnesses Kosnik and Marx and can hopefully say more about the incident and about the actions of his group at the time.

Finally there was a fourth request to add the email from the Hamburg police to Marx and Kosnik to the evidence. This document is, despite its relevance, still not part of the file.

The defense also announced that there will soon be another request for new witnesses, because the text for the request was not yet finished.

While the prosecutor did not yet want to respond to the requests, the judge already decided that officer Krischlak will be heard as soon as possible. Next week the judge will respond to the other three requests and there will hopefully be a start to the hearing of Krishlak.

Next week the process will continue on Monday and Thursday. The newley planned court dates after this are not yet known, but will be published as soon as possible. Show your solidarity with Peike and come to the court in Hamburg!
