Donderdag 5 april vond de negende dag van Peike’s hoger beroep plaats. Ook bij deze zitting was United We Stand weer buiten de rechtbank aanwezig met muziek en koffie, en bestond het publiek uit zowel Duitse als Nederlandse vrienden en kameraden.

De zitting begon met de de reactie van de aanklager op het nieuwe bewijs dat de verdediging in de vorige zitting had aangedragen. Hij stelde in zijn pleidooi dat het helemaal niet nodig is het videomateriaal nog te bekijken. Politieagent Kosnik (één van de twee tot nu toe gehoorde getuigen) zegt immers Peike de flesjes te hebben zien gooien. Er is volgens de aanklager dus geen twijfel over de vraag of Peike schuldig is aan de feiten waar hij van verdacht wordt.

Vervolgens verklaarde de rechter dat de strafdaad volgens een agent uit de Soko Schwarzer Block (1) niet in de video te zien is. Hoewel zij door dit te zeggen toonde niet al te positief tegenover het nieuwe bewijs te staan, bleef echte uitspraak over het wel of niet behandelen van het nieuwe bewijsmateriaal uit. De verdediging mag namelijk eerst nog op de reactie van de aanklager reageren, voordat de rechter daadwerkelijk besluit. Dit zal waarschijnlijk allebei op 19 april gebeuren. Tijdens deze zitting zal dan ook de nieuwe getuige gehoord worden.
Tenslotte stelde de rechter dat het pleidooi van de verdediging uit de vorige zitting wordt afgewezen. Voor haar bestaat, net als voor de aanklager, geen twijfel over het feit dat Peike schuldig is. Hierna werd de zitting gesloten.

Op dit moment staan er nog drie zittingsdagen gepland, waarbij alle steun van aanwezigen ontzettend gewaardeerd blijft. Ook zal er naar de laatste geplande zitting een bus gaan vanuit Amsterdam, waardoor we hopelijk met zo veel mogelijk mensen bij de zitting aanwezig zullen zijn om Peike te tonen dat hij er niet alleen voor staat.

The ninth day of Peike’s higher appeal took place on Thursday April 5. United We Stand were outside again with music and coffee, while inside the court room German as well as Dutch friends and comrades were present.

The session begun with the prosecution’s response to the new proof brought to court by the defense during the last session. In his plea, he argued that it is not at all necessary to look at the video material, for agent Kosnik (one of the two witnesses heard until now) has already stated he had seen Peike throw the bottles. According to the prosecution, there is thus no doubt whatsoever whether Peike is guilty of the facts he is accused of.

Subsequently the judge declared that, according to a cop from the Soko Schwarzer Block (1), the fact itself cannot be seen in the video. Although this statement indicates that she does not care too much about the new proof, an actual decision concerning whether or not to use the new material was not made. Since the defense will first have the occasion to react to the prosecution’s statement, the judge will only decide afterwards whether to use it or not. This will probably happen on April 19. During this session the new witness will also be heard.
Finally the judge stated that the defense’s plea from the last session will be disregarded. For her, as for the prosecution, there is no doubt that Peike is guilty. After this the session ended.

At this point, there are three more sessions planned, during which all support from those present continues to be extremely appreciated. There will be a bus from Amsterdam driving to Hamburg on the day of the last session; this will hopefully bring as many people as possible to the court, so we can show Peike he is not alone.
