Vandaag, dinsdag 3 april, was de achtste dag van het hoger beroep. Aansluitend op de afgelopen procesdag begon de zitting met het bekendmaken van de invulling van de nu nog geplande procesdagen. Zowel de rechter als de aanklager bevestigden dat hun agenda, na het horen van de nieuwe getuige, leeg is. Deze getuige, een collega van Marx en Kosnik uit Berlijn, is op vakantie, dus kan dit pas op 19 april gebeuren. De zitting van vandaag was dus volledig in te vullen door de verdediging.
De verdediging startte met een aanvraag voor nieuw videobewijsmateriaal. De akte bevatte tot nu toe namelijk enkel algemene videobeelden van verschillende locaties en momenten tijdens de avond van de Welcome to Hell-demo. Dit materiaal was deel van de akte om ‘een impressie van de situatie te geven’, maar was voor Peike’s zaak eigenlijk volledig irrelevant. De SoKo Schwarzer Block (1) blijkt nu echter ook beelden te hebben die wél van de tijd en locatie van Peike’s arrestatie zijn. Dit materiaal heeft de verdediging vandaag aangedragen als nieuwe bewijsvoering in het proces.
Verder reageerde de verdediging uitgebreid op de argumentatie van de rechter uit de vorige zitting. Het meerendeel van het tot nu toe gebruikte ‘bewijs’ én de volledige onderbouwing voor het weigeren Peike zijn proces in vrijheid af te laten wachten, werden uitvoerig besproken en weerlegt.
Na het horen van de verdediging stelde zowel de rechter als de aanklager tijd nodig te hebben voor hun reactie op deze twee bijdragen. De zitting werd dan ook, hoewel deze van 9:00 tot 17:00 gepland stond, na slechts een half uur weer gesloten. Komende donderdag zal het proces verder gaan. In deze zitting zal in ieder geval de rechter op de bewijsaanvraag reageren.
Net als vandaag zal United We Stand donderdag weer in solidariteit met Peike vóór de rechtbank aanwezig zijn voor iedereen die naar daarheen komt om Peike te supporten. Kom ook!

Today, tuesday the 3rd of april, was the eighth day of Peike’s appeal procedure. The hearing began with announcements of the content of all now-planned trial days. Both the judge and the prosecutor confirmed that their agenda is empty after hearing the new witness. This new witness, a colleague of Marx and Kosnik, is on vacation, so her hearing can only take place on the 19th of april. Therefore, thee session today was completely free to fill in by the defense.
The defense started with requesting new video footage as evidence. Until now, the case file only included video footage of different locations and moments during the evening of the Welcome to Hell-demo. This footage was part of the file to give a general ‘impression of the situation’, but was in Peike’s case completely irrelevant. The SoKo Schwarzer Block (1) now appears to have footage shot at the location and time of Peike’s arrest. This footage that has been requested to be brought forth as new evidence in the trial.
Furthermore, the defense reacted extensively to the judge’s argumentation from the previous session. The larger part of the ‘evidence’ that has been used up until now, as well as the complete argumentation for declining the motion to let Peike await his trial in freedom, were all extensively discussed and refuted by the defense.
After hearing the defense, both the judge as well as the prosecutor claimed needing time for their reaction to these two additions. Though it was planned to last from 9:00 until 17:00, the session ended after half an hour. Coming thursday the trial will continue. In this session at least the judge will give a reaction to the request of evidence by the defense.
Just like today, United We Stand will be in front of the courthouse, in solidarity with Peike, to be there with coffee and breakfast for everyone who comes to support Peike. Come as well!
